Marriage Licenses

You may apply for an Idaho Marriage License in any county in Idaho if you are to be married in Idaho.

Licenses are issued in the Recorder’s Office Monday through Friday 8 am to 5 pm. No appointment is necessary. No waiting period or blood tests are required.

Requirements for people over 18 years of age:

  • Both people need to appear at the courthouse in person
  • Both need forms of photo identification
  • Both need social security numbers or:
    • A letter from social security stating why they don’t have one and a birth certificate, passport, or other documentary evidence issued from a foreign jurisdiction and proof they are in the US legally.
  • Fill out marriage license application form.
  • Pay the fee of $30 – cash or check only

Requirements for people under (18) years of age (but over 16) in addition to those requirements above:

  • A parent for each person under (18) must also appear
  • The parent must present a notarized statement of consent
  • An original or certified copy of a birth certificate of the underage party must be presented
  • No one under the age of (18) may marry a person over the age of (18) if there is more than 3 years age difference between them

Requirements for people under the age of (16) in addition to those requirements above:

  • Must have an Order from the Magistrate Judge allowing them to marry

Two copies of the marriage license are issued. The officiant will complete them after the ceremony. One copy is for the couple and one copy is to be returned to the Recorder’s office for recording. It may be mailed or returned in person.

Once recorded, a certified copy of the marriage license will be mailed to the parties at the address they request and the recorded original will be forwarded to Idaho Vital Statistics.

A marriage may be solemnized by the following officials: a priest or minister of any denomination, a mayor, current/retired magistrate judge, district judge, supreme court justice or Idaho Tribal judge; current or former governor, lieutenant governor.

Custer County doesn’t require anything additional from officiants.
